Understanding the 30% Ruling Eligibility

The 30% ruling is a tax advantage for highly skilled migrants moving to the Netherlands for a specific employment role. When you qualify, your employer can pay you up to 30% of your salary as a tax-free allowance. This is designed to cover the extra costs of moving and living abroad (extraterritorial costs). To be eligible, you must be recruited from outside the Netherlands, live more than 150 km from the Dutch border, and meet specific minimum salary requirements.

30% Ruling Step-Down Schedule

As of 2024, new rules introduced a scale-down mechanism over the 5-year duration of the ruling. Note: Employees who already had the ruling applied in Dec 2023 may be subject to transitional rules.

Frequently Asked Questions

Who qualifies for the 30% tax ruling in the Netherlands?

The 30% ruling is available for foreign employees recruited from abroad who bring specific expertise to the Netherlands. You must meet specific salary thresholds and lived more than 150 km from the Dutch border before being hired.

What is the minimum salary for the 30% ruling in 2025?

The standard taxable salary threshold is expected to be indexed for 2025. In 2024, it was €46,107 gross per year (excluding the 30% tax-free allowance). For under-30s with a qualifying Master's degree, it was €35,048.

How does the 30% step-down rule affect my net salary?

Under the new rules starting 2024, the tax-free percentage steps down: 30% for the first 20 months, 20% for the next 20 months, and 10% for the final 20 months. This means your net salary will decrease as the tax-free allowance reduces over time.

Can I use the 30% ruling if I am a self-employed person (ZZP)?

Self-employed individuals (ZZP) cannot directly apply for the 30% ruling as it requires an employment contract. However, setting up a BV (limited company) and becoming a director-major shareholder (DGA) might allow you to qualify, subject to strict conditions.

What happens to my 30% ruling if I change employers?

You can transfer the 30% ruling to a new employer if you sign a new contract within 3 months of leaving your old job and still meet all the salary and expertise requirements.

How do I apply for the 30% ruling?

You and your employer must apply jointly to the Dutch Tax Authorities (Belastingdienst). If applied within 4 months of starting your job, it can be granted retroactively from your start date.
